PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS OF LIABILITY, A CLASS ACTION WAIVER, AND A JURY TRIAL WAIVER.
These Terms of Service ("Terms" or "Agreement") are entered into between Shivay Tech LLC, with a registered address at 971 US Highway 202N, STE R, Branchburg, NJ 08876, United States ("Company," "Shivay Tech," "we," "us," or "our"), and you ("you" or "User").
These Terms govern your access to and use of:
the mobile application operating under the title Estate Simulator (the "App");
the website www.shivaytech.net (the "Site"); and
related functionality and services made available by Shivay Tech (collectively, the "Services").
By selecting "Agree & Continue," accessing or using the App, or otherwise electronically accepting these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms and the applicable End User License Agreement ("EULA").
You also acknowledge that you have had an opportunity to review our Privacy Policy, which describes how information is handled in connection with the App.
If you do not agree to these Terms or the EULA, do not use the App or Services.
You must be at least thirteen (13) years old to use the App.
If you are under the age of majority in the jurisdiction where you live, you may use the App only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
You represent that you are legally permitted to use the Services under the laws applicable to you.
The App is not directed to children under 13.
Estate Simulator is a fictional entertainment game.
The App simulates inheritances, estates, collectible property, item values, rental income, sales, donations, reputation, net worth, and other financial or property-related concepts solely for gameplay and entertainment.
Nothing contained in the App constitutes or is intended to constitute:
financial advice;
investment advice;
legal advice;
tax advice;
estate-planning advice;
real-estate advice;
appraisal services; or
any other professional advice.
You should not rely on any values, prices, descriptions, financial calculations, returns, rental amounts, appreciation, depreciation, probabilities, or other information displayed within the App when making real-world decisions.
Estate Simulator does not provide real investment products, financial accounts, estates, inheritances, property interests, securities, or ownership rights.
All items, letters, estates, values, income, net worth, reputation, statistics, rewards, and other gameplay elements within Estate Simulator are virtual game elements only.
Virtual items and game values:
do not represent ownership of real property or physical goods;
have no real-world monetary value;
cannot be redeemed for cash;
cannot be exchanged for real property, securities, currency, goods, or services;
cannot be transferred outside the App unless Shivay Tech expressly introduces such functionality; and
do not represent a debt, financial obligation, deposit, investment, or stored-value account owed by Shivay Tech.
References to "value," "net worth," "income," "rent," "sale," "donation," "inheritance," "appraisal," "gain," "loss," or similar terms describe simulated game mechanics only.
You acquire no ownership interest in any real-world object merely because a corresponding virtual item appears in your Collection.
Estate Simulator contains game mechanics involving randomized or variable outcomes.
These may include:
which virtual items are revealed;
rarity levels;
simulated item values;
value changes;
setbacks or other events;
rewards;
rental income;
reputation gains; and
other gameplay outcomes.
Any displayed rarity rates, probabilities, value ranges, or similar statistics relate only to the operation of the game.
The Company may adjust gameplay mechanics, balancing, probabilities, values, rewards, rarity distributions, item attributes, progression systems, or other game parameters as the App evolves.
Such changes may increase or decrease the usefulness, rarity, simulated value, or gameplay effect of virtual items previously obtained.
Except where prohibited by applicable law, you are not entitled to compensation because of a change to game balancing, values, probabilities, or other gameplay mechanics.
Estate Simulator is supported in part by advertising.
The App may display advertisements supplied by third-party advertising providers, including Google AdMob.
Advertisements may include interstitial advertisements and voluntarily selected rewarded advertisements.
The App may offer you the opportunity to voluntarily view an advertisement in exchange for a specified in-game benefit, such as unlocking an additional inheritance letter or other gameplay opportunity.
A reward is granted only when the advertising provider confirms that the applicable rewarded-ad requirements have been successfully completed.
Availability of rewarded advertisements is not guaranteed.
An advertisement may be unavailable, interrupted, fail to load, fail to complete, or fail to return the necessary completion confirmation because of circumstances outside Shivay Tech's control.
Shivay Tech is not responsible for advertisements that are unavailable or cannot be completed because of network conditions, third-party advertising systems, device restrictions, or other circumstances outside our reasonable control.
We may change, limit, replace, or discontinue particular advertising rewards or advertising opportunities at any time.
Shivay Tech does not necessarily endorse the products, services, claims, or content displayed in third-party advertisements.
Your interactions or transactions with advertisers are between you and the applicable advertiser.
Advertising-related data practices are described in our Privacy Policy.
Estate Simulator primarily stores gameplay progress locally on your device.
Locally stored data may include your:
Collection;
opened letters;
virtual net worth;
simulated item values;
reputation;
rental status and income;
gameplay history;
preferences; and
other game progress.
Shivay Tech does not currently maintain a Company-operated cloud account or server-side backup of your game progress.
As a result, game data may be permanently lost if, for example:
you uninstall the App;
you clear the App's storage;
your device is lost, damaged, reset, or replaced;
stored application data becomes corrupted;
an operating-system event removes local data; or
another event affects storage on your device.
Device-level backup or restoration services provided by Apple, Google, or another platform provider may operate independently of Shivay Tech and are outside our control.
Shivay Tech does not guarantee that local gameplay data can be recovered.
Estate Simulator may offer local notifications relating to daily gameplay content or other game events.
Delivery of notifications depends on factors outside Shivay Tech's control, including:
notification permissions;
device settings;
operating-system behavior;
power-management settings;
time and timezone settings; and
other device-level restrictions.
We do not guarantee that any notification will be delivered at a particular time or at all.
You remain responsible for managing your device notification settings.
Certain Estate Simulator features may depend on dates, time, timezone information, or other device settings.
Changing your device clock, timezone, local storage, application files, or similar device state may affect gameplay.
You agree not to intentionally manipulate device settings, application data, advertising systems, or other mechanisms for the purpose of improperly obtaining rewards, bypassing gameplay restrictions, duplicating virtual items, or otherwise exploiting the App.
We may modify the App to prevent or correct exploitation, unintended gameplay behavior, corrupted game states, or abuse.
Some artwork, item descriptions, letters, names, locations, stories, flavor text, or other content appearing within Estate Simulator may have been created or assisted by artificial intelligence or other automated content-generation tools during development.
The App does not require real-time artificial-intelligence processing of your gameplay data for these pre-generated materials.
Generated, fictional, or curated content may occasionally contain errors, inconsistencies, unrealistic information, historical inaccuracies, or unintended similarities to real persons, places, businesses, products, or events.
Unless expressly stated otherwise, characters, inheritance scenarios, letters, valuations, stories, and gameplay situations within Estate Simulator are fictional or presented for entertainment purposes.
Any resemblance to actual persons, living or dead, or actual events may be coincidental unless specifically identified otherwise.
You should not treat any simulated appraisal, description, historical statement, location, value, legal statement, or other game content as authoritative real-world information.
The App, Site, software, source code, interfaces, designs, graphics, artwork, text, game systems, audiovisual elements, databases, trademarks, logos, and other materials made available through the Services ("Company Content") are owned by, licensed to, or otherwise lawfully used by Shivay Tech to the extent protected by applicable intellectual-property law.
These Terms do not transfer ownership of the App or Company Content to you.
Subject to these Terms and the EULA, you receive only the limited right to personally use the App.
Except as permitted by applicable law or expressly authorized by Shivay Tech, you may not:
reproduce or distribute Company Content;
sell, sublicense, rent, lease, or commercially exploit Company Content;
modify or create unauthorized derivative works from the App;
remove copyright, trademark, or proprietary notices;
extract or republish substantial portions of the App's content or databases; or
use Company Content to create or operate a competing service.
Additional license terms governing the software itself are contained in the EULA.
You agree not to misuse the Site, App, or Services.
You may not:
use the Services for unlawful purposes;
attempt to gain unauthorized access to the App, systems, data, or services;
intentionally interfere with or disrupt operation of the Services;
introduce viruses, malware, malicious code, cryptocurrency miners, or similar harmful software;
bypass or circumvent technical protections or gameplay restrictions;
manipulate advertising completion signals or fraudulently obtain rewarded-ad benefits;
modify application data for the purpose of cheating or exploiting gameplay;
reverse engineer, decompile, or disassemble the App except to the extent such restriction is prohibited by applicable law;
scrape or automatically extract substantial amounts of Company Content;
infringe the intellectual-property, privacy, publicity, or other rights of another party; or
use the App in a manner that violates applicable law.
The App may depend upon or interact with third-party services, platforms, or technologies, including:
Apple and the Apple App Store;
Google Play and Google Play Services;
Google AdMob;
operating-system services;
device backup services; and
websites or services linked from advertisements or other App content.
Third-party services are governed by their own terms, policies, and privacy practices.
Shivay Tech does not control and is not responsible for third-party:
availability;
outages;
advertisements;
content;
privacy practices;
security practices;
policy changes;
services; or
actions.
The Site, App, or advertisements displayed within the App may contain links to websites or services not owned or controlled by Shivay Tech.
We do not control or endorse third-party websites merely because they are accessible through the App or an advertisement.
Your use of third-party websites and services is at your own discretion and subject to the third party's terms and privacy practices.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, APP, SERVICES, GAME CONTENT, AND COMPANY CONTENT ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."
SHIVAY TECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
THE APP WILL OPERATE WITHOUT INTERRUPTION OR ERROR;
GAME DATA WILL NEVER BE LOST OR CORRUPTED;
ADVERTISEMENTS WILL ALWAYS BE AVAILABLE;
REWARDED ADVERTISEMENTS WILL ALWAYS COMPLETE SUCCESSFULLY;
NOTIFICATIONS WILL ALWAYS BE DELIVERED;
GAME VALUES OR CALCULATIONS WILL BE ACCURATE OR CONSISTENT WITH REAL-WORLD VALUES;
GAME CONTENT WILL BE ERROR-FREE;
ANY PARTICULAR VIRTUAL ITEM WILL BE OBTAINED;
ANY PARTICULAR GAMEPLAY RESULT WILL OCCUR; OR
THE APP WILL REMAIN AVAILABLE INDEFINITELY.
NO INFORMATION WITHIN ESTATE SIMULATOR CONSTITUTES LEGAL, FINANCIAL, TAX, INVESTMENT, REAL-ESTATE, ESTATE-PLANNING, OR OTHER PROFESSIONAL ADVICE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHIVAY TECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, GAME PROGRESS, PROFITS, REVENUE, BUSINESS, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO:
YOUR USE OR INABILITY TO USE THE APP OR SERVICES;
LOSS OR CORRUPTION OF LOCAL GAME DATA;
CHANGES TO GAME MECHANICS OR VIRTUAL VALUES;
ADVERTISING OR THIRD-PARTY CONTENT;
FAILURE OF A REWARDED ADVERTISEMENT;
NOTIFICATION FAILURES;
THIRD-PARTY SERVICES;
INTERRUPTIONS OR DISCONTINUATION OF THE SERVICES; OR
RELIANCE UPON SIMULATED OR FICTIONAL INFORMATION WITHIN THE APP.
TO THE EXTENT LIABILITY CANNOT LAWFULLY BE EXCLUDED, SHIVAY TECH'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:
THE AMOUNT YOU PAID DIRECTLY TO SHIVAY TECH FOR THE APP OR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR
FIFTY U.S. DOLLARS (US $50).
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF SHIVAY TECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Shivay Tech LLC and its officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable attorneys' fees arising from:
your unlawful or unauthorized use of the Site or App;
your material violation of these Terms; or
your violation of another person's rights.
This obligation does not apply to the extent a claim results from Shivay Tech's own unlawful conduct or where such indemnification is prohibited by applicable law.
We may update, modify, rebalance, add, remove, suspend, or discontinue all or any portion of Estate Simulator at any time.
This may include changes to:
gameplay mechanics;
items;
letters;
virtual values;
rarity levels;
probabilities;
rewards;
advertisements;
daily limits;
reputation systems;
rental systems;
user interfaces; and
other App features.
We do not guarantee continuous or uninterrupted availability of the App.
Updates to your operating system, app marketplace requirements, third-party SDKs, technical infrastructure, laws, or other circumstances may affect availability or functionality.
You may stop using the App at any time, including by uninstalling it.
We may suspend or terminate access to all or part of the Services if reasonably necessary because of:
violation of these Terms;
fraudulent or abusive activity;
security concerns;
legal requirements;
third-party platform requirements; or
discontinuation of the Services.
Provisions that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions, will survive termination.
We may update these Terms to reflect changes to Estate Simulator, our business practices, third-party services, applicable law, or other circumstances.
The "Last Revised" date at the beginning of these Terms identifies the latest revision.
For material changes, we may require you to review and electronically accept the revised Terms before continuing to use the App.
Your continued use of the App after any required acceptance constitutes agreement to the revised Terms.
If you do not agree to revised Terms that require acceptance, you must discontinue use of the App.
Your privacy is important to us.
Our Privacy Policy explains how gameplay data, advertising-related information, device information, support communications, and other information may be handled in connection with Estate Simulator.
The Privacy Policy is available through the App and at our Site.
The App is offered from the United States.
We make no representation that Estate Simulator or its content is appropriate or legally available in every jurisdiction.
You are responsible for complying with laws applicable to your use of the App.
Nothing in these Terms is intended to waive consumer rights that cannot legally be waived under the law applicable to you.
Except to the extent applicable consumer law provides otherwise, these Terms and any dispute, controversy, or claim arising out of or relating to these Terms, the Site, the App, or the Services shall be governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles.
To the fullest extent permitted by applicable law, you and Shivay Tech LLC agree that any legal action or proceeding arising out of or relating to these Terms, the App, or the Services shall be brought exclusively in:
the state courts of New Jersey located in Middlesex County, New Jersey; or
the United States District Court for the District of New Jersey where federal jurisdiction exists.
Each party consents to the personal jurisdiction of those courts and waives objections to venue or inconvenient forum to the fullest extent permitted by law.
Nothing in this Section deprives a consumer of any mandatory protection or forum right that cannot legally be waived under applicable law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND SHIVAY TECH LLC AGREE THAT ANY DISPUTE BETWEEN YOU AND SHIVAY TECH WILL BE RESOLVED SOLELY ON AN INDIVIDUAL BASIS.
YOU AGREE NOT TO BRING OR PARTICIPATE IN A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING.
NO CLAIM MAY BE COMBINED OR CONSOLIDATED WITH ANOTHER PERSON'S CLAIM EXCEPT WITH THE WRITTEN CONSENT OF ALL PARTIES OR AS OTHERWISE REQUIRED BY LAW.
THIS SECTION DOES NOT APPLY WHERE SUCH A WAIVER IS PROHIBITED OR UNENFORCEABLE UNDER APPLICABLE LAW.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND SHIVAY TECH LLC KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS, THE APP, OR THE SERVICES.
THIS WAIVER DOES NOT APPLY WHERE A JURY-TRIAL WAIVER IS PROHIBITED OR UNENFORCEABLE UNDER APPLICABLE LAW.
Except as expressly provided in the applicable EULA or as required by an app marketplace, these Terms do not create enforceable rights for any person or entity other than you and Shivay Tech LLC.
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.
The remaining provisions will remain in full force and effect.
Failure by Shivay Tech to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
These Terms, together with the applicable EULA and any other policies or terms expressly incorporated into them, constitute the agreement between you and Shivay Tech relating to your use of the Services.
In the event of a conflict between these Terms and the EULA regarding the license to use the App, the EULA will control with respect to that licensing issue.
